Chapter 8: Inbound Call Compliance and Required Disclosures

In this video, I discuss how to be compliant when taking inbound calls. Many businesses assume "implied" consent from inbound callers would allow them to outbound dial them in the future, but this is no longer true. You must capture or confirm prior express consent before you can outbound dial or text a person or business that has previously inbound called your company.

Chapter 9: Buying Leads from Third-Party Affiliates

In this video, we walk through the use case of a buyer and seller arrangement where a 3rd party affiliate "seller" captures prior express written consent from a lead, and then transfers that consent to contact over to a "buyer" in exchange for payment.

Chapter 10: Compliance for Social Media Lead Ads and Direct Messages (DMs)

In this video, we discuss the specific use case of capturing prior express written consent from social media lead ads (Facebook, Instagram, TikTok, LinkedIn, etc) and then using that consent to contact leads outside of social channels using programmatic AI voice and text. We also discuss the use case of communicating on the social platforms, and what the additional terms of use and limitations are for each channel.

Chapter 11: Compliance for Email
Short summary of the new TCPA rules, aka the Lead Generator Rule, going live on January 27, 2025.
In this video, we discuss the specific use case of using an email to text service. This loophole was used by many marketers and sales people as a way to text recipients without prior express written consent, and the new TCPA rules effectively close this loophole making it no longer legal to do this activity in the United States when contacting consumers or enterprises, especially if they are on the DNC list.

Chapter 12: Do Not Call List Requirements
Short summary of the new TCPA rules, aka the Lead Generator Rule, going live on January 27, 2025.
In this video, we discuss the specific use case of texting recipients, either consumer or commercial, who are on the National Do Not Call Registry (DNC). We also discuss how the new TCPA rules regarding prior express written consent supersede any DNC registration; in other words, if an individual provides prior express written consent to your business but is also on the DNC registry, you are allowed to contact them with voice and text using AI technology.

Chapter 13: Key Differences Between Contacting Consumers and Enterprises
Short summary of the new TCPA rules, aka the Lead Generator Rule, going live on January 27, 2025.
In this video, we discuss the specific use case of contacting businesses that have not given prior express written consent using AI voice and text aka robodialing. Unfortunately the loophole that allowed businesses to programmatically call or text other businesses appears to now be closed with this new rule, and our legal team advises businesses to find new channels for finding leads. The reality is that very few use cases remain that are safe for B2B companies if they plan to use AI technology in their voice and text workflows, unless of course your leads have provided prior express written consent, in which case your are safe to use AI voice and text.
